Welcome to Spitfire Solutions ("the Platform"). By accessing or using our platform, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the service. These Terms constitute a legally binding agreement between you and Spitfire Solutions.
You must authenticate via Steam or Discord to use the Platform. You are solely responsible for maintaining the security of your account and all activity that occurs under it. Spitfire Solutions is not liable for any loss or damage arising from unauthorised access to your account. You must not share your account credentials or transfer your account to another person.
Spitfire Solutions acts solely as a technology platform that facilitates transactions between Buyers, Store Owners, and Developers. We are not a party to any transaction between users. We do not own, control, or endorse any Store, Package, Mod, or other user-generated content. All transactions are between the Buyer and the applicable Store Owner or Developer. Spitfire Solutions is not responsible for the quality, safety, legality, or delivery of any goods or services offered through the Platform.
All purchases are processed through our third-party payment provider (PayPal). Prices are displayed in the Store's configured currency and may be converted to your local currency by the payment provider at checkout.
All sales of digital goods are final. Due to the nature of digital content and in-game item delivery, refunds are not guaranteed and are handled at the sole discretion of the Store Owner or Developer. Spitfire Solutions does not process refunds directly — any refund requests must be directed to the Store Owner or Developer who sold the item. Chargebacks or payment disputes filed without first contacting the seller may result in account suspension.
All users are solely responsible for determining, collecting, reporting, and remitting any and all applicable taxes (including but not limited to GST, VAT, sales tax, income tax, or any other tax) arising from their use of the Platform.
For Buyers: You are responsible for any taxes applicable to your purchases. Prices displayed on the Platform are exclusive of tax unless otherwise stated by the Store Owner. Spitfire Solutions does not calculate, collect, or remit taxes on behalf of Buyers.
For Store Owners & Developers: You are responsible for registering for, collecting, and remitting all applicable taxes on your sales in accordance with the laws of your jurisdiction. This includes but is not limited to income tax, goods and services tax (GST), value added tax (VAT), and any other sales or transaction taxes. Spitfire Solutions does not act as a tax agent, does not provide tax advice, and makes no representations regarding your tax obligations. You should consult a qualified tax professional regarding your specific obligations.
Platform Fees: The platform commission (currently 15% on mod sales) is a service fee charged by Spitfire Solutions. Store Owners and Developers are responsible for accounting for this fee in their own tax filings as applicable.
Store packages (kits, ranks, currency, commands) are delivered via RCON or database commands to the specified game server. Delivery depends on server availability, correct player identification (Steam ID / EOS ID), and server configuration. Spitfire Solutions is not responsible for:
In-game items and ranks have no real-world monetary value and cannot be exchanged, traded, or redeemed for cash.
Mods and plugins sold on this Platform may include source code, compiled assets, or custom commission work. Purchasing content grants you a non-exclusive, non-transferable licence to use and modify the content for personal or server use only. You may not:
Content uploaded to third-party platforms (e.g., CurseForge) is additionally subject to that platform's terms.
Developers are solely responsible for the content they upload. Content must not infringe on copyright or intellectual property rights, contain malware or malicious code, or violate any applicable laws. Developers warrant that they have the right to sell and distribute any content they upload. Spitfire Solutions reserves the right to remove any content and suspend accounts that violate these terms without notice or compensation.
Platform Subscriptions: Store Owner subscriptions (e.g., Free, Pro, Enterprise) are billed on a recurring basis. You may cancel at any time; access continues until the end of the current billing period. Subscription features and pricing are subject to change with 30 days' notice.
Store Package Subscriptions: Some Store packages may be sold as recurring subscriptions (e.g., monthly ranks). If payment fails to renew, there is a 3-day grace period before the subscription expires. Upon expiry, any granted in-game ranks, permissions, and Discord roles will be automatically removed. No refunds are issued for partial subscription periods.
All Platform design, branding, logos, and proprietary code are the property of Spitfire Solutions and are protected by applicable intellectual property laws. User-generated content remains the property of the respective creators. ARK: Survival Evolved, ARK: Survival Ascended, and related trademarks are the property of Studio Wildcard / Snail Games. Minecraft is a trademark of Mojang / Microsoft. All other game trademarks belong to their respective owners. Spitfire Solutions is not affiliated with or endorsed by any game publisher.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPITFIRE SOLUTIONS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, IN-GAME ITEMS, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure. Our total aggregate liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to Spitfire Solutions (not to Store Owners or Developers) in the 12 months preceding the claim.
Without limiting the above, Spitfire Solutions is not liable for:
You agree to indemnify, defend, and hold harmless Spitfire Solutions and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your tax obligations; or (e) any content you upload or transactions you conduct through the Platform.
Disputes between Buyers and Store Owners or Developers should be resolved directly between the parties. Spitfire Solutions may assist with mediation through the support ticket system but is under no obligation to resolve disputes. Any disputes between you and Spitfire Solutions shall be governed by the laws of New Zealand and resolved in the courts of New Zealand.
We collect minimal data required for authentication and transactions (Steam ID, Discord ID, email address, IP address, and transaction records). We do not sell your personal data to third parties. Payment information is handled entirely by our payment processor (PayPal) — we do not store credit card or bank details. By using the Platform, you consent to the collection and use of this information as described.
Spitfire Solutions reserves the right to suspend or terminate your account at any time, with or without notice, for any reason including but not limited to: violation of these Terms, fraudulent activity, chargebacks, abuse, or inactivity. Upon termination, your right to use the Platform ceases immediately. We are not liable for any loss resulting from account termination.
We may update these Terms at any time. Material changes will be communicated via the Platform or email (where available). Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
